Genetic testing has familial implications. Counsellors find themselves in (moral) conflict between medical confidentiality (towards the patient) and a potential right or even duty to warn at-risk relatives. Legal regulations vary between countries. English literature about German law is scarce. We reviewed the literature of relevant legal cases, focussing on German law, according to the Preferred Reporting Items for Systematic Reviews and Meta-Analyses guidelines. This article aims to familiarise counsellors with their responsibilities, compare the situation between countries and point out (...) legally unresolved areas.According to the German Genetic Diagnostics Act (Gendiagnostikgesetz) in case of an ‘avoidable or treatable’ genetic disorder, geneticists ought to confine themselves to the obligated advice to the patient. Whether a breach of the duty of confidentiality can be justified in exceptional cases by ‘necessity as justification’ for actively informing relatives at risk remains legally unclear. In case of a ‘neither avoidable nor treatable’ genetic disease, geneticists should also refrain from actively informing relatives as the justifiable state of emergency does not permit to break the duty of confidentiality. During the 1920s and 1930s the testing of blood groups for large numbers of people became a very common practice. Although much of this was to ensure compatibility for blood transfusion, over 1,000 articles were published with results of tests on over 1.3 million people to answer more theoretical, scientific questions. The motivation for much of this research was the possible link between the well established hereditary blood types and other possible inherited traits. Because the existence of the blood groups (...) was a rather sudden discovery, the record of this publication offers an excellent case study of the diffusion of new scientific knowledge. Differences in the beginning of blood group research from country to country reveal some important influences of social setting on the spread and application of the new discoveries. (shrink)

The Rockefeller Foundation helpedestablish two health research institutes inFrance during the German occupation and Vichyrule. These institutes were the precursors ofthe Institut National de Santé et de laRecherche Médicale (INSERM), the Frenchequivalent of the National Institutes of Healthin the United States. This essay rescues theseinstitutes from oblivion, and examines theirorigins and their significance.

Monitoring the environment for visual events while performing a concurrent task requires adjustment of visual processing priorities. By use of Bundesen's (1990) Theory of Visual Attention (TVA), we investigated how monitoring for an object-based brief event affected distinct components of visual attention in a concurrent task. The perceptual salience of the event was varied. Monitoring reduced the processing speed in the concurrent task, and the reduction was stronger when the event was less salient. The monitoring task neither affected the temporal (...) threshold of conscious perception nor the storage capacity of visual short-term memory nor the efficiency of top-down controlled attentional selection. The present article on John Dewey aims at pursuing the traces of the reception of Dewey’s work in France. It is intended as a survey of the writers who have taken note of Dewey and his ideas, and is meant to function as a sort of additive inventory, with no claim to comprehensiveness. Some of the articles mentioned were unfortunately unavailable for direct examination and are thus listed merely for purposes of information.Although the educational and philosophical writings of John Dewey (...) are actually indivisible, Dewey’s oeuvre has not been read in France and Europe generally as of a piece, but has largely been registered in terms of those parts which have relevance to education and teaching. Indicative of this is the fact that it took until 1975 forDemocracy and Education -the book which, in Dewey’s own view, most clearly presented his linking of pedagogy and philosophy — to be published in France. Gérard Delledalle, the translator ofDemocracy and Education, is the only person so far in France to have dealt systematically with the whole of Dewey’s writings. He has translated other works by Dewey and has written several books on him, dealing expressly with Dewey’s philosophy of pragmatism as the foundation of his theory of education.It is actually inadequate to restrict the reception of Dewey’s work to France alone. Rather, one should speak of francophone Europe, for the first translations of Dewey’s educational writings into French were made by Adolphe Ferrière, Ovide Decroly and édouard Claparède — a Swiss, a Belgian, and a Frenchman. It was thanks to them that Dewey’s thoughts on education began to make an impact on the francophone movement for school reform in the early twentieth century.Discussion of his theory of education is typified in France as well by a division into proponents of a concept of ‘learning by doing’ indebted to Dewey and representatives of authoritarian forms of education, which reject Dewey. Although French thought has not yet concerned itself closely with pragmatism, Dewey’s opponents believed that they could denounce him and his theories simply by levelling the charge of “pragmatism.” This dualistic mode of thinking which appears to be deeply rooted in France has proved to be an obstacle to the reception of Dewey and has led to neglect and rejection of his theories. But at the same time, it must be said that the degree of absorption which the essays reveal has about it an air of quaintness, as if, in reading them, one had suddenly discovered a community of people who spoke nothing but Elizabethan English. For the (...) problems constructed and dealt with in this way emerge from some earlier philosophical clime: from the worlds of Meinong's Investigations Into the Theory of Objects and Russell's Lectures on Logical Atomism, where the talk is of "elementary propositions," "The Ideal Language," "bare particulars," "denoting," what "subsists" as distinct from what "exists," and so on. If any of the writers are aware of the contributions made to philosophy by the later Wittgenstein (mentioned briefly only once in the text, p. 89), Wisdom (not referred to at all), Austin (who appears in a footnote as a translator of Frege), Ryle (mentioned once), and Strawson, this awareness is suppressed with a ruthlessness that borders on perversity. There is clearly here no feeling for the changes that have occurred in philosophy since 1933, or any awareness of the fact that the problems, which they pose, stem to a large extent from just those presuppositions which led to the abandonment of Logical Atomism some thirty years ago./n saying these things, I am, of course, not to be understood as implying that ontological investigations per se are always to be discounted, or that "progress in philosophy is linear," but merely that the fecundity of this particular mode of investigation has long since been shown to be exhausted. Finally, it is surprising to the reviewer that the volume does not contain a paper by Professor Gustav Bergmann. Most of the authors are former students of Professor Bergmann --and their work coincides with the scope of his own interests, as well as reflecting a similar approach to the problems being dealt with. This large volume of the Revue de Synth~se deserves special notice, even though it is impossible to give it a critical review here. Here are gathered critical, empirical reports from competent scientists and other savants, including the whole range and all the domains of knowledge, on the concrete aspects of experience which special fields and methods of knowing reveal. Viewing experience from this wide perspective, and including in it what the Germans have called Erlebnis in order to do justice to the empirical aspects of existentialism as well as of phenomenology, these scholars have performed a basic service for the sciences and for philosophy. In addition to the more traditional distinctions between cognitive, moral, aesthetic, and religious experience, there are illuminating accounts of geological and biological empiricism (relating the terrestrial sciences to nuclear and cosmic sciences), and of experience englobante as distinguished from experience objective.
